Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tider platform, operated by Tider ApS, Copenhagen, Denmark. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Tider platform, you confirm that you have read, understood, and agree to these Terms. If you are using Tider on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

Tider provides a cloud-based booking and management platform for sports venues, including but not limited to padel centres, tennis clubs, and other sports facilities. Our services include online booking, court management, membership management, payment processing, and related tools.

3. Account Terms

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years of age to use Tider.
  • One person or entity may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Payment Terms

For venue operators on paid plans:

  • Subscription fees are billed in advance on a monthly or annual basis.
  • All fees are exclusive of VAT and applicable taxes unless stated otherwise.
  • You authorize us to charge your payment method for recurring subscription fees.
  • Refunds are handled on a case-by-case basis. Contact support for refund requests.
  • We reserve the right to change pricing with 30 days' notice.
  • Transaction fees for bookings are charged as specified in your plan.

5. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to any part of the platform or its systems.
  • Interfere with or disrupt the integrity or performance of the platform.
  • Upload or transmit viruses, malware, or other harmful code.
  • Scrape, crawl, or use automated means to access the platform without permission.
  • Impersonate another person or entity.
  • Use the platform to send unsolicited communications (spam).

6. Intellectual Property

The Tider platform, including its design, code, features, and content, is owned by Tider ApS and protected by intellectual property laws. You retain ownership of any data you upload to the platform. By using Tider, you grant us a limited license to use your data solely to provide and improve our services.

7. Data and Privacy

Your use of Tider is also governed by our Privacy Policy. For venue operators, a Data Processing Agreement (DPA) is available upon request.

8. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the platform ceases immediately. We will retain your data for a reasonable period to allow data export, after which it will be deleted in accordance with our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Tider ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to Tider in the 12 months preceding the claim.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure at all times.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform at least 30 days before they take effect. Your continued use of Tider after the changes take effect constitutes your acceptance of the updated Terms.
